Anaplan Events Terms and Conditions
These Event Terms and Conditions (“Terms”) apply to your registration for and participation in an online or in-person Anaplan event (“Event”). You acknowledge that you have read, understood, and agree to these Terms which are incorporated by reference into the Registration Form and create an agreement (the “Registration Agreement”) between you and Anaplan, Inc. and its related entities (“Anaplan,” “we,” “our” or “us”). These Terms are in addition to any terms and conditions established by the Venue hosting the Event “Venue.”
1. Participation
You may only register for and attend the Event in accordance with these Terms. In order to participate in the Event, you must:
1. Be authorized to enter into these Terms.
2. Have read and understood these Terms.
3. Have accepted the Registration Agreement
4. Be at least 18 years of age. If alcohol is being served, 21 years of age (or otherwise over the legal drinking age of the Event jurisdiction)
2. Safety and Security
Anaplan is dedicated to making our events a safe and productive environment for all.
2.1 Unacceptable Behavior. We do not tolerate any conduct or content which:
1. Is harassing, threatening, demeaning, discriminatory or obscene.
2. Causes concern for the safety or security of Event participants, partners, sponsors, speakers, moderators, vendors, organizers, or volunteers.
3. Would constitute a criminal offense, give rise to liability, or otherwise constitute illegal activity.
4. Infringes the intellectual property, privacy, or other rights of participants or sponsors.
Additionally, all Event participants must refrain from:
1. Wearing clothing that is not suitable for a professional work environment, that is provocative, inappropriate, or otherwise potentially
offensive.
2. Possessing a weapon (or anything that can be used as a weapon) or illegal substance.
3. Smoking in non-smoking areas.
4. Vandalizing or destroying personal property of others, the Event site or materials.
5. Possessing any receptacle containing any alcoholic beverages except in areas specifically designated for alcohol consumption.
2.2 Expected Behavior. All Event participants are expected to:
1. Be considerate, respectful, and collaborative.
2. Refrain from demeaning, discriminatory, or harassing behavior and speech.
3. Be mindful of your surroundings and of your fellow participants. Alert event staff if you notice a dangerous situation or someone in distress.
4. Wear your badge or name tag at all times while at the Event or Event venues.
You understand that you and your property may be subject to a reasonable search upon entry to the Event and you may be asked to provide photo identification. Attendance at the Event is subject to any health and safety policies, assessments, precautions and/or protocols put in place by government agencies, the venue operator and/or Anaplan, including requirements relating to face masks and/or enhanced health screenings. Without limiting remedies under applicable law, if you fail to comply with these Terms or any other agreement between Anaplan and you, Anaplan may take action in our sole discretion, including rescinding your registration or attendance at the Event or any future events without refund (if applicable). Please report any non-compliance with these Terms using the contact details on the Event registration page.
3. Cancellation or Changes to Events
3.1 By You. If registration fees or other fees are required for the Event, cancellation instructions and the Event’s refund policy will be listed on the Event’s registration webpage. If the Event is free of charge, we ask that you inform Anaplan of your cancellation by submitting an email to the contact listed on the Event’s registration webpage.
3.2 By Us. Anaplan reserves the right, without prior notice, to change or cancel the Event at any time for any reason including health or safety grounds, availability or suitability of the Venue or speakers, and we may deny, limit, or cancel your Event registration or participation at any time. We are not responsible for any damages, direct or indirect, resulting from such cancellation.
3.3 Effect of Cancellation. If the Event is canceled, the sections entitled “Your Information,” “Risk, Liability, and Indemnification,” “Governing Law and Dispute Resolution,” and “Miscellaneous” will continue to apply.
4. Data Privacy
By registering and/or participating in the Event wherever physically or virtually via video or web conferencing platforms/tools, you acknowledge that your personal data will be processed to manage your participation in the Event and in accordance with our Privacy Statement.
5. Data Sharing
5.1 Generally. By submitting registration details or participating in sessions or other activities wherever physically or virtually, you agree to allow Anaplan to process personal data in accordance with our Privacy Statement. You agree and acknowledge that personal information submitted during registration may be shared with Event sponsors, exhibitors, affiliates of Anaplan’s Event, Event app providers, networking providers, registration providers, media partners, government entities or regulatory authorities as required by law. You further acknowledge that personal data such as name, contact information, company, job title, and country may be used to create a delegate list (physical or digital) which may be shared with other Event sponsors, vendors, exhibitors or other Event participants and such parties may contact you in the future. You will be subject to such third party’s communications and privacy practices. If you wish to opt-out or exercise any applicable privacy rights you may have regarding these third-party communications, please exercise those rights directly with those third parties.
5.2 Badge Scanning. Upon entrance to the Event, you may be issued a badge containing RFID or NFC tags for the purposes of recording your Event participation and admission (including engagement with any vendor or exhibitor and at Event sessions). By using your badge at an Event, you hereby authorize the operator of the badge scanner or similar technology to collect and process personal information provided at registration related to Event attendance.
5.3 Event Mobile App. By attending our in-person Events, you may have the option to download a mobile software application (“App”) to assist in your participation and plan your schedule for the Event. If you decide to use the App, Anaplan will share your contact details provided at registration with the App operator to allow you to be authenticated when accessing the App.
6. Personal Release
By registering and/or participating in the Event wherever physically or virtually via video or web conferencing platforms/tools, you acknowledge that you may be photographed, recorded (video and/or audio) or web streamed while attending the event by Anaplan (and/or others on behalf of Anaplan). Your image, likeness, statements, voice, or other identifying characteristics (each an “Image”) may be captured in such photographs, recordings, webcasts, podcasts or other transmissions of the Event (each a “Recording”).
You grant to Anaplan and its affiliates, agents, employees and assigns an irrevocable, nonexclusive, perpetual, royalty-free, transferable, and fully sublicensable right and license to use, reproduce, edit, distribute, display in any format or media now known or hereafter developed Recording or Images for any purpose including trade, advertising, sales, publicity, education without compensation to you or any third-party. Your Images may appear in Recordings made available to the public and third parties may retain, use, or distribute such Recording or Images. Anaplan is not responsible for and has no control over any use, or misuse by any third party of Recording or Images.
To the maximum extent permitted by law, you hereby irrevocably waive any right you may have in the Recordings and Images or any reproductions thereof and you agree that Anaplan has no obligation to use any Recording or Image.
7. Speakers, Sponsors, Vendors and Exhibitors
Views expressed by any participant, speaker, vendor, exhibitor, or sponsor at the Event are their own. Anaplan shall have no liability for views expressed by any participant, speaker, vendor, exhibitor, or sponsor at the Event or in any material provided to participants.
8. Assumption of Risk
You acknowledge and agree that attending and participating in the Event is voluntary and you understand the nature of the Event. To the maximum extent permitted by law, you agree that you knowingly and voluntarily assume the risks associated with attending and participating in the Event including risk of personal injury or damage to your personal property. You hereby waive any claims you may have against Anaplan, any affiliated party, event sponsor or exhibitor relating to such risks.
9. Limitation of Liability
ANAPLAN AND OUR AFFILIATES AND LICENSORS WILL NOT BE LIABLE TO YOU UNDER ANY CAUSE OF ACTION FOR LOST PROFITS, REVENUES, CUSTOMERS, OPPORTUNITIES, GOODWILL OR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES. THE MAXIMUM AGGREGATE LIABILITY OF ANAPLAN AND OUR AFFILIATES AND LICENSORS FOR ALL DAMAGES, LOSSES AND CAUSES OF ACTION UNDER THESE TERMS WILL NOT EXCEED USD $100.
10. Governing Law
These Terms will be governed by and construed in accordance with the laws of the State of California without regard to choice or conflicts of law rules. In the event of a claim, demand, cause of action, controversy, or dispute, you and Anaplan hereby consent to the exclusive jurisdiction of any state or federal court sitting in San Francisco County or in the United States District Court for the Northern District of California.
11. Force Majeure
Anaplan will not be liable for any delay or failure to perform any obligation under these Terms to the extent such delay or failure results from any cause beyond our reasonable control, including fire, flood, earthquake, storm, or other elements of nature, strike or labor disputes, pandemics, epidemics or other health crises, electrical or power outages, utilities or other telecommunication failures, cyber-attacks, ransomware attacks, availability of the Venue (if applicable), blockages, embargoes, travel restrictions, riots, acts or orders of government, acts of God, acts of terrorism, or war.
